Perelman’s lawsuit against Morgan Stanley takes unexpected direction

James Comyns gave an affidavit about his approach of three jurors in Ronald Perelman’s case against Morgan Stanley stating he is not involedin the case.
In an affidavit, James Comyns, said he came to the state courthouse looking for Perelman lawyer Jack Scarola, who is also representing Mr. Comyns and his wife in a pending civil case. "Mr. Scarola has been terribly busy seven days a week and we can’t get time with him," Mr. Comyns wrote.
According to his statement, Mr. Comyns approached a number of people, including jurors 6, 8 and 9 in the Perelman case, but did not try to influence them in any way.
Mr. Perelman, the chairman of cosmetics giant Revlon Inc., is suing Morgan Stanley accusing the company that it hid from him and other investors Sunbeam’s accounting woes in pursuit of big investment-banking fees in the 1998 sale.
The judge ordered that Mr. Comyns should swear an affidavit regarding his discussions with the jurors.
Morgan Stanley argued yesterday that the incident is a reason for a mistrial. The trial started four weeks ago, and Mr. Perelman finished giving his testimony yesterday.
